Early Marriage Regarding Child Protection

Abstract


Marriage or marriage is an important event in life. With marriage, a person will get a balance of life both biologically, psychologically, and socially. According to the marriage law, the minimum age limit for a person to marry is if the woman has reached the age of 16 and the man has reached 19 years. Meanwhile, based on the Law on Child Protection, the age of married women is over 18 years. But in reality, the practice of early marriage or child marriage is still rampant among the community. This article aims to find out how early marriage practices are related to child protection. The method used in this research is a type or research approach in the form of a library research (library research). Then the data sources that are used as research material are laws, books, journals and internet sites related to the chosen topic, namely early marriage. then the process of selecting, comparing, combining, and sorting various meanings is carried out until they are found that are relevant. The results showed that a marriage at an early age could not fulfill the requirements stipulated in Article 6, namely the free will of the bride and groom because she was not yet an adult. And having a marriage that is before the age of 18 is a violation of Law No.35 of 2014 concerning Child Protection, which is a further rule of Article 28B paragraph (2) of the 1945 Constitution.
